Preservation, collection, review, and production of ESI in civil litigation is governed by the relevant State or Federal Rules of Civil Procedure and supervised by a neutral judicial officer, who can assist the parties and resolve disputes that may arise. Not so in the context of government agency or internal investigations. They can be wide-ranging and informal, and there is no neutral authority for the parties to consult. But responding parties in investigations are not entirely helpless – there is growing sophistication among requesting agencies and a willingness to engage in cooperative efforts to define scope, search methodology, form of production, privilege claims, and other issues. Led by David Shonka, Acting General Counsel of the Federal Trade Commission, members of Sedona Conference Working Groups 1, 6, and 11 will share their developing Principles and Best Practices in this area.
